Terms and conditions

Services associated with the Website and App (jointly referred to hereinafter as the "Service") are created, developed, and provided by SFSG.

By using the Service, you acknowledge full acceptance of the Terms and Conditions, referred to hereinafter as "T&C" (including our Privacy Policy). The Service is regularly updated by SFSG and these T&C may also be modified or supplemented at any time. Users of the Service are thus invited to view them as often as possible to get familiar with their content.

The Service is normally accessible to users at all times. However, SFSG may decide to interrupt service for technical maintenance at any time for reasons it deems appropriate.

1. Description of the services provided

The Service primarily allows users to play and compose music by manipulating prerecorded sound loops depicted as icons that are dragged and dropped on animated characters. The Service also makes it possible to save, share, and download musical compositions. These digital music compositions can be accessed with a unique URL. Access to certain sound content ("versions") and features are reserved exclusively for users of the App. SFSG may at its sole discretion and at any time temporarily or permanently modify, suspend, improve, or interrupt any aspect of the Service.

SFSG endeavors to provide information and features that are as accurate as possible through the Service. Nevertheless, it cannot be held liable for any omissions, inaccuracies, and defects in the updates of these items, whether they be the result of its own actions or those of third-party partners.

2. Contractual limitations on technical data

The Service uses PHP, HTML, CSS and JavaScript technologies to function.

SFSG cannot be held liable for any direct or consequential damages sustained by the user's hardware during access to the Service that arise from either the appearance of a bug or an incompatibility, whether as a result of the use of hardware not meeting the specifications described on the Website (see supported platforms in our FAQ), or in the information provided on the App download platforms. Consequently, the user agrees to use recent hardware that is free of viruses and equipped with an updated, latest-generation browser or operating system.

3. Intellectual property and counterfeiting

SFSG is the owner of the intellectual property rights and holds the rights of use over all items accessible on the Service, such as brands, logos, illustrations, graphics, icons, images, photos, sounds, texts, or computer codes of its own production.

Any reproduction, representation, modification, publication, distribution, and adaptation of all or part of the items of the Service, including software, written, visual, or sound items, regardless of the method or procedure used, is prohibited, except with the prior, written authorization of SFSG.

The audio files made available to users of the Service via the musical compositions download feature are subject to the same rules. All sound loops offered on the Service for use in composing the music obtained via the Service are the exclusive property of SFSG. Consequently, any products downloaded from the Service can only be used for personal and non-commercial purposes. Any reproduction, transmission, sale, separation, alteration, or modification other than for personal aims is strictly prohibited (as specified in our FAQ). Any use other than for personal and non-commercial purposes must be authorized in writing, in advance, by SFSG. The User may only modify the WAV/MP3 format of the downloaded audio file to make it compatible with his/her player and for his/her strictly personal use.

Any unauthorized use of the Service or any of the items it contains will be considered counterfeiting and will be prosecuted pursuant to the provisions of Articles L335-2 et seq. of the Intellectual Property Code.

4. Personal data management

Use of the Service is also subject to our Privacy Policy. By using the Service, you accept the terms of our Privacy Policy, which forms an integral part of these T&C.

No personal information of users of the Service is published without the user's knowledge, or exchanged, transferred, disclosed, or sold on any kind of media whatsoever to third parties. Only the eventual purchase of the Service or SFSG and its rights would permit the transmission of said information to the future purchaser, who would in turn be under the same obligation regarding the retention and modification of data vis-à-vis the user of the Service.

The databases are protected by the provisions of the French law of July 1, 1998 implementing Directive 96/9 of March 11, 1996 on the legal protection of databases.

Notification of the Website has been filed with the CNIL under number 1560959 v 0.

5. Hyperlinks and cookies on the Website

The Website contains a certain number of hyperlinks to other websites, put in place with the authorization of SFSG. Nevertheless, SFSG is not able to verify the content of websites visited in this manner and as a result, does not accept any liability related thereto.

Browsing the Website may result in the installation of cookie(s) on the user's computer. A cookie is a small file that does not make it possible to identify the user, but saves information related to a computer's browsing on a website. Data obtained in this manner are used to facilitate subsequent browsing on the Website and also make it possible to obtain various browsing statistics.

Refusing the installation of a cookie may make it impossible to access certain services. The user may still configure his/her computer so as not to accept cookies (open your browser settings and disable cookies).
